This agreement made and entered into this day of 2006 by and between RICJO'S Kennels, and referred to as Buyer. In consideration of the mutual conventions and agreements herein after set forth, it is agreed as follows:

The Buyer agrees that the prefix (RICJO'S) will go 1st in naming said dog on MKA registration. The Buyer agrees to show said dog in any conformation show. The Buyer will be responsible for all costs of showing. Said dog must not be bred until Championship is completed unless discussed with RICJO'S Kennels owner.
This contract is written for the protection of the Breeder/Breeder, the Buyer, and foremost the Puppy. To the best of Breeders knowledge the puppy is in good health at the time of sale as per routine veterinarian examination. The buyer at the buyers option and expense, should have the puppy examined by a veterinarian of Buyers choice within 72 hours of the delivery of the puppy from Breeder to Buyer, and is urged to do so. The guarantee will be extended if the 72 hours should lapse on a holiday or Sunday. However, this guarantee does not cover any health issue caused by neglect or injury.
If a veterinarian examines the Puppy and finds it to be "unfit/unhealthy” the Buyer may return the puppy for a full refund, provided the puppy has not been injured or neglected. The Veterinarian must provide a written statement that the puppy is "unhealthy ". This must be done in the first 72 hours, no exceptions.
The Breeder reserves the right to have the puppy examined at a veterinarian of the Breeders choice as a second opinion, a veterinary finding of intestinal parasites does not make the puppy unfit/unhealthy for purchase, unless the condition is such that the overall health of the puppy is seriously affected at that time.

HEALTH GUARANTEE
Should the dog develop one or more life threatening illness or genetic problems within the first three years, diagnosed by a veterinarian as precluding puppy from living an otherwise normal and healthy life as a PET Quality Cocker, the Breeder will be notified in writing within 48 hours of diagnosis and buyer shall have the following options to:
A.; Keep the dog, spay/ neuter the current dog and accept a replacement puppy of the same quality originally purchased. The replacement will be selected by the breeder from the next available litter and provided upon proof of spay/neuter and return of the MKA. Registration Certificate. There will be no refund of the purchase price; this is a replacement guarantee only. Breeder reserves the right to a possible waiting time of six months to make this replacement, as puppies are not available at all times. Breeder also reserves the right to request the puppy be returned, depending on the circumstances.
B.; Return the puppy/dog to the breeder along with all documentation and veterinarians reports and MKA Registration Certificate, and accept a replacement as outlined above. The Breeder reserves the right of a possible waiting time of six months to make this replacement, as puppies are not available at all times.
The Breeder is not responsible for any charges incurred in returning or replacing the dog. The Breeder is not responsible for any veterinarian charges or fees in diagnosing or treating any illness or genetic disease. The dog will not be replaced if used for breeding, nor if any conditions resulting from abuse, neglect or accident result in death. If death occurs, an autopsy shall be performed at buyer’s expense to determine the exact cause of death. The results shall be sent in writing to the Breeders
veterinarian, prior to any replacements.

OWNER REQUIREMENTS
Buyer agrees to take all measures necessary to insure that puppy does not have an opportunity to
give all immunizations, as recommended by veterinarian.
Dog is to be checked for internal parasites every three months until one year of age.
Puppy/dog is to be placed on heartworm preventative at 6 months of age.
If illness occurs, dog is to receive immediate veterinarian care and all prescribed treatment is to be followed.
The Breeder is not responsible for fees or charges for veterinarian care for treatment of illness or determination of illness or disease. If diagnosed for a health problem that falls within the Health Guarantee, Breeder will be notified in writing, Including any veterinarian findings and test results within 48 hours of such diagnosis. Written proof will be required to verify all the above.
RETURN POLICY
In the event you are unable to keep the dog for any reason, he/she agrees to notify the Breeder immediately, at NO time will the dog go to a shelter or pound. The Breeder will have the option of finding new home for the dog; however, no refund will be given if the Buyer chooses to return the dog. In the event of "resale" buyer must notify the Breeder and provide the new owners name, address, and phone number.
The Buyer agrees that the Breeder may repossess the animal upon evidence of neglect, abuse, or breeding at no expense to the Breeder, and no refund of money.
The Buyer agrees that the puppy will reside at the home of the Buyer. And not be chained or tied outside. This animal is sold with the understanding that it was to go to select homes, socialized properly, and become a member of the family.
The Buyer agrees that he/she is not acting as or in part of; an agent in the purchase of this puppy and that Buyer will not sell this puppy or any of its progeny to any agent, pet store, or dog business.
The entire Agreement between the parties is contained herein.
